PLEASE READ THESE TERMS OF USE CAREFULLY AS THEY CONTAIN IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES AND OBLIGATIONS. BY SUBMITTING A COMMENT TO TRAFFIX YOU AGREE TO BE BOUND BY THE FOLLOWING TERMS AND CONDITIONS.

By submitting any comment in any format to TRAFFIX, the TRAFFIX website, social media platforms or any other forum, you hereby waive any and all expectations of privacy that you may have with respect to such submission, including, but not limited to, any expectation of anonymity in relation to comments, photos, videos, data, metadata or any other information submitted by you to TRAFFIX.

You acknowledge and agree that any submission made by you to TRAFFIX may be subject to the Virginia Freedom of Information Act or otherwise made available by TRAFFIX for public review and comment. You acknowledge and agree that once a submission is made by you, TRAFFIX will have no obligation to remove, delete or return the submission. To the fullest extent permitted by law, you grant TRAFFIX an irrevocable, non-exclusive, royalty-free and transferable license to use, reproduce, distribute or display your submission in any media formats and through any media channels that exist now or may be developed in the future for any purpose by TRAFFIX and/or the Transportation District Commission of Hampton Roads t/a Hampton Roads Transit, its subsidiaries or assigns.

You warrant that your submission does not contain any material that is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission from their rightful owner to post the material.

You agree not to make a submission that contains:

• Offensive, derogatory, vulgar or obscene language or material;
• Libelous, harassing or abusive language or material; or
• Personal information or likenesses of other persons without their consent.

You agree that TRAFFIX has the sole and plenary power to determine whether your submission contains prohibited content or otherwise violate these Terms and Conditions. In the event a submission is determined by TRAFFIX to contain prohibited content, TRAFFIX may, in its sole discretion, restrict or prohibit further comment by you on the TRAFFIX website or other platforms.

YOU AGREE TO INDEMNIFY AND HOLD TRAFFIX HARMLESS FROM AND AGAINST ANY AND ALL LOSSES, LIABILITIES, ATTORNEY’S FEES, COSTS AND EXPENSES ARISING OUT OF OR RELATED TO ANY BREACH OF THESE TERMS AND CONDITIONS.
